Can SSDI benefits be awarded for intermittent flare periods?

On Behalf of | Oct 10, 2024 | Social Security Disability |

Social Security Disability Insurance (SSDI) benefits are designed to provide financial assistance to individuals who are unable to work due to a disabling medical condition. Many people suffer from conditions that are not consistently debilitating but instead cause intermittent flare-ups. Common examples include autoimmune disorders and certain chronic conditions. When flares are intense, a patient may be unable to work. Is SSDI available to them at such times?

The answer to this question depends on several factors, including the severity of the condition at issue, the frequency of an applicant’s flare-ups and how their condition impacts their ability to maintain gainful employment.

SSDI definition of disability

The Social Security Administration (SSA) has a strict definition of disability. To qualify for SSDI benefits, an individual must have a medically determinable impairment that is expected to last for at least 12 months or result in death. Additionally, the condition must prevent the individual from performing substantial gainful activity. For individuals experiencing intermittent flare-ups, the challenge lies in proving that their condition, even during periods of remission or lessened symptoms, will prevent them from maintaining full-time employment for at least 12 months.

Understanding each applicant’s flare activity

In cases where individuals suffer from intermittent flare-ups, the SSA will look closely at the frequency and severity of these episodes. To qualify for SSDI, the flare-ups must occur frequently enough, and be severe enough, that they prevent an applicant from maintaining a stable work schedule. If a person’s condition forces them to miss work regularly due to flare-ups, or if they are unable to predict when they will experience a period of severe symptoms, they may have a strong case for SSDI benefits.

SSDI benefits can be awarded for intermittent flare periods only under specific circumstances. Those who want a stronger sense of whether these benefits are worth applying for – given the ins and outs of their unique situation – tend to benefit from seeking personalized legal guidance.
